Why This Matters

This bill sets deadlines for federal review of geothermal leasing applications. It requires decisions within 60 days after completing required environmental reviews, even if a lawsuit is pending unless a court vacates or blocks the application.

Who this affects
Geothermal energy developers · Department of the Interior · federal courts
What changes is this bill making?
  1. 1Adds a new subsection to the Geothermal Steam Act of 1970 to govern processing of geothermal lease applications.
  2. 2Requires the Secretary of the Interior to approve or deny permit, sundry notice, notice to proceed, right-of-way or other authorization applications no later than 60 days after all federal reviews are complete, including NEPA (National Environmental Policy Act), ESA (Endangered Species Act), and relevant historic preservation reviews.
  3. 3Specifies that pending civil actions cannot delay processing unless a federal court vacates or issues an order blocking the specific lease or permit.
  4. 4Clarifies that the bill does not give courts any new power to vacate or block authorizations beyond existing authority.
  5. 5Defines “authorization” broadly to include any license, permit, approval, finding, determination or other administrative decision needed for a geothermal project.
  6. 6Applies to any valid existing geothermal lease and related authorizations under federal law.

Geothermal Energy Opportunity Act or the GEO Act This bill expands the Geothermal Steam Act of 1970 to establish a deadline for the Department of the Interior to process applications related to geothermal leases. Specifically, Interior must process each application for a geothermal drilling permit or other authorization under a valid existing geothermal lease within 60 days after completing all requirements under applicable federal laws and regulations (including the National Environmental Policy Act of 1969, the Endangered Species Act of 1973, and the National Historic Preservation Act) unless a U.S. federal court vacates or provides injunctive relief for the underlying lease.
