Gun Trace Information Access Bill
Official: Equal Access to Justice for Victims of Gun Violence Act of 2025
This bill allows victims of gun violence to use gun trace information in court, making it easier to hold manufacturers accountable. It removes legal protections that currently shield gun makers from lawsuits.
Equal Access to Justice for Victims of Gun Violence Act of 2025This bill removes limitations on the civil liability of gun manufacturers and the disclosure of gun trace data in civil actions. Specifically, the bill repeals the Protection of Lawful Commerce in Arms Act, which prohibits civil actions against a firearm or ammunition manufacturer, seller, importer, dealer, or trade association for damages resulting from the criminal or unlawful misuse of a firearm. Additionally, the bill states that firearms trace data maintained by the Bureau of Alcohol, Tobacco, Firearms and Explosives is not immune from legal process. Such data is subject to discovery; is admissible as evidence; and may be used, relied on, or disclosed in a civil action or administrative proceeding.
1. This bill would repeal parts of a law that protects gun manufacturers from lawsuits. 2. It would allow gun trace information to be used as evidence in civil court cases. 3. The bill aims to make it easier for victims of gun violence to seek justice. 4. Gun trace data would be accessible during legal proceedings, similar to other types of evidence. 5. This change applies to both state and federal courts.
