Why This Matters

This bill directs the United States Trade Representative to seek alignment among the United States, Mexico, and Canada on national security reviews of foreign investments under the United States-Mexico-Canada Agreement (USMCA). It aims to have Canada and Mexico adopt rules similar to those in U.S. law and to create a mechanism for coordinated responses to investment threats from nonmarket economy countries.

Who this affects
United States Trade Representative · Treasury Department · State Department · foreign investors
What changes is this bill making?
  1. 1States that Canada and Mexico are top trading partners and that strong investment reviews support jobs and supply chains under the USMCA (United States-Mexico-Canada Agreement).
  2. 2Requires the Trade Representative to advocate that each USMCA country adopt legislative and regulatory frameworks for reviewing foreign investments for national security similar to section 721 of the Defense Production Act of 1950.
  3. 3Calls for a coordination mechanism among USMCA countries to address shared threats from investments by nonmarket economy countries such as the People’s Republic of China.
  4. 4Directs the Trade Representative to work with the Treasury and State departments to provide technical assistance, including expert advisers, training, grants, and study tours, to help Mexico and Canada establish these review frameworks.
