Why This Matters

Who this affects
Employers · Current employees · Prospective employees
What changes is this bill making?
  1. 1Employers must include the wage or salary range in every public or internal job posting.
  2. 2If no job posting is provided to an applicant, the employer must disclose the wage or range before discussing pay and whenever the applicant asks.
  3. 3Employers must tell each employee their position’s wage range when hired, at least once a year, and whenever the employee asks.
  4. 4Employers may not punish or retaliate against any applicant or employee for asking about or relying on these wage disclosures.
  5. 5Violations carry civil fines of five thousand dollars for a first offense and up to ten thousand dollars for later offenses.
  6. 6Employees or applicants can sue for statutory damages between one thousand and ten thousand dollars or for actual damages, plus attorney fees.
  7. 7Legal actions can be filed in federal or state court on behalf of individuals and others in the same situation.
