Why This Matters

This bill lets certain children adopted abroad by U.S. citizens automatically become U.S. citizens, regardless of when their adoptions were finalized. It sets rules for those living in the United States when the law takes effect and those arriving later.

What changes is this bill making?
  1. 1It updates the Immigration and Nationality Act (INA) to cover adopted children who meet the INA 101(b)(1)(E), (F), or (G) requirements, no matter when their adoption was finalized.
  2. 2Children adopted before age 18 who were admitted lawfully and living in the United States on the law’s enactment date automatically become citizens on that date.
  3. 3Children who meet the same adoption and admission conditions but who are living abroad become citizens when they enter the United States lawfully.
  4. 4Adopted immigrants covered by this law cannot be denied entry under the usual inadmissibility rules in INA section 212(a).
  5. 5These adoptees must pass a criminal background check before receiving a visa, and if they have unresolved crimes, the Department of Homeland Security and the State Department must coordinate to address them.
