Why This Matters

This resolution cancels a Health and Human Services decision that let the department skip public notice and comment on new rules about grants, benefits, and contracts. If passed and signed, the department's 50-year-old promise to ask for public input before making those rules would return.

If you get Medicaid or depend on Health and Human Services grants, you would again get a chance to comment before many of those program rules change.
Who this affects
Medicaid enrollees · Health grant recipients · State health agencies · Federal health contractors
What does this resolution do?
  1. 1The 1971 Richardson Waiver, named for former Health, Education, and Welfare Secretary Elliot Richardson, would be restored after Health and Human Services ended it on March 3, 2025.
  2. 2The federal Administrative Procedure Act lets agencies skip public comment on rules about grants, loans, benefits, contracts, and public property, but the waiver gives up that exemption.
  3. 3With the waiver back, the department would again post proposed rules on programs like Medicaid and public health and research grants and accept public comments first.
  4. 4Under the Congressional Review Act, the department also could not issue a substantially similar rule ending the waiver unless Congress later approves it.
